mike’s defense

so what’s mike defensor up to, dredging up the rot of the nbn-zte-fg deal that saw (alleged fixer) ben abalos resign as comelec chief and the project stopped in its tracks.   natabunan na nga ng walang katapusang iba’t ibang atraso at iskandalo ng arroyo govt, dapat ay nagsasaya na lang si mike, jun lozada’s camp was rather quiet, tila lusot na ang mag-asawang arroyo — thanks to romy neri, let’s not forget — at tila okey na lang sa bayan na hintayin ang 2010, malapit na naman, after all.   goodbye gloria, no immunity from suit.

so why?   i don’t buy mike’s spin that it’s just a perjury issue, nothing political daw, he just wants to clear his name.   josko.   eh walang kalatoylatoy ang inihain niyang kaso.

In his complaint for perjury, Defensor said Lozada had given conflicting versions of their conversation:

“Mr. Lozada’s testimony before the Senate significantly deviated from what he gave before the Court of Appeals. In the Senate, he stated that I asked him to deny that he was kidnapped; in the [appellate court] however, he said I asked him to deny any knowledge about the NBN-ZTE deal.

“The statement of Mr. Lozada before the Senate and the appellate court are clearly contradictory and cannot be reconciled. After validating the completeness of my story before the Senate, Mr. Lozada cannot thereafter change its tenor in the court hearing without being held liable for perjury.”

But on Nov. 14, 2008, Judge Jorge Emmanuel Lorredo of the Manila Metropolitan Trial Court (MTC) Branch 26 found no inconsistency on Lozada’s part and dismissed Defensor’s complaint.

In his ruling, Lorredo said: “In the second and third statements [at the Court of Appeals], Lozada was given the impression that if he does not stop, there will be a demolition job against him.

“The Court notes that even in [his Senate testimony], Mike Defensor also said ‘Tapusin na natin ‘to.’ To the Court, that shows the intention of Mike Defensor to put an end to all these things about the ZTE deal …”

well, mike is so lakas, a manila regional trial court obligingly reversed the decision.

Manila RTC Branch 11 Presiding Judge Cicero Jurado Jr. reversed Lorredo’s decision on March 19, upon Defensor’s appeal through his counsel, the Fortun Narvasa lawfirm.

Jurado said the MTC went “a notch above” the requirement for determining probable cause and seemed to have already rendered a verdict without conducting a trial when it concluded that an element of the offense was absent.

He said the question at hand was whether there was evidence showing that a crime had more likely been committed and the accused should be placed under custody.

it is quite conceivable to me that in that conversation between mike and jun, a lot more was said, including both statements mike takes issue with.    and neither is illogical in the context of the other, so what’s the fuss?

obviously naghanap lang ng dahilan to get lozada out of the hands of the religious / civil society and into the hands of the judiciary, where the arroyo admin has some influence (from the lowest to the highest courts) as we can see.   and, really, it has to be connected with jun lozada being urged to run for the senate in 2010.   may panalo kasi (inggit si mike), so the idea is to neutralize him early, let him run from jail, let him serve from jail?    trillanes shows the way?

if mike really wants to clear his name for the sake of his children, it’s simple: withdraw his support from the arroyo administration.   fat chance, yes, but that would wipe the slate clean.

rocking with da reyna

quite interesting how manolo’s mistake spun off debates on academic credentials & credibility in the comment threads of filipino voices.com and reynaelena.com,  and quite quite yummy how fv blogger benignO’s entry that manolo’s apology empowers “dimwits” added fuel to da reyna’s war on yet another fv blogger with homophobic ethics, yes the ilusyonado one who claims more than 8 million readers a day, lol.

naturally the conflict finds me siding with da reyna, having myself (hindi ako nag-iisa) been viciously attacked not too long ago by yet yet another fv blogger across three blogs — in fv, in his personal blog, and in mine — one irrational accusatory insulting diatribe after another, castigating me for abetting the abu sayyaf, condoning terrorism, giving away territory, even torture, moral turpitude, stinking words, apalling, disgusting, lack of humanity and womanity (!) at kung ano-ano pang kalait-lait daw about my person and my morals and my intellect, when nothing in my entry warranted it.   the same fv blogger now gleefully claiming that manolo’s apology is “full of sarcastic, if hidden wit” but the reyna just doesn’t get it, and in the next breath talking “standards of civility.” talaga naman, ano ba yan.

worse, not a peep from editor-not-chief nick, as though the utter lack of tolerance for any deviation from an arrogantly opinionated one’s opinion is all right.   as though it’s perfectly acceptable for fv to be used as a platform for sensationalist writing and irresponsible labelling.

The Ca_t is right:

Some writers and bloggers at Filipino Voices are guilty of being pa-intellectual. Feeling ba. Some are so uber-napoleonic with their own opinions, think and believe in all their ass that they’re the only one that is all knowing, high and mighty and what they say and write sway the nation. They believe that whatever they say would help create national policies and every one in the tralala-land gets their piece of opinion!

unfortunately, ito ang attitude ni nick-not-chief:

Ipersonally believe that the readers should be able to discern for themselves with regards to many issues..

…which is like washing his hands of any responsibility for anything.   e ano kung walang karapatan ang ilang taga-fv to speak for filipinos.    e ano kung walang karapatan kahit sino na mang-insulto o mambastos.   wtf.   is this the same nick who stood up and accused malu fernandez of stuff that some of his bloggers are now accused of?   ah, but nick is not the chief, there is no chief.

filipino voices could use a leader who would value the collective as a whole and not be intimidated by the noisy know-it-alls, never mind if their pasaway ways bring in traffic.    the kind of leader who at the very least would impose standards of honesty and civility.   otherwise fv is suspect as a source of credible information and rational opinion, because how can anyone tell that the good ones have not been infected by the bad ones?   all it takes is one rotten apple to spoil the barrel.   three or four speeds up the process.

this is also to say that i don’t agree with the conventional blogging wisdom that values more the freedom to say anything than the rightness, correctness, of what is said in the context of nation-building, especially for a collective blog that claims to sway public opinion and shape government policy.    leaving it to readers to “discern for themselves” who’s right and who’s wrong is such a cop-out and just so mainstream media.

check out radical chick‘s take on the u.p. friday the 13th riot that found burgis youth freaking out, as in OhMyGodWhatTheFuckIDON’TWANTTODIE, and suggesting that the u.p. admin close the university and limit access only to u.p. people.  haha, as if u.p. were close-able.  and, hey, what does it tell us about these u.p. youth and about u.p. diliman today.  how burgis naman talaga.

in fairness, alex maximo’s post in reaction to radicalchick’s is gracious and thoughtful, more agreeable than defensive, pero defensive pa rin, of course — he was misinterpreted, he wasn’t done, it’s a stream of consciousness in process.  well, possibly.  benefit of the doubt, just because some of the thoughts are worth remarking on.  particularly the ones regarding that clear line drawn between the jologs and the burgis, and about being burgis:

For the longest time, I have been arguing that the discourse of the blogosphere is the discourse of the burgis. At one point, I considered playing the anti-burgis role in the blogosphere but dropped the thought altogether. The fact remains that I am burgis and all the people I know who blog are burgis too. I’ve resigned to the fact that there will always be struggle between classes and, as a member of the petty-bourgeois, it is inevitable for me to acknowledge the differences between social classes.

Whether the burgis guns for egalitarianism in their discourse or not is based on their own ideologies and now I do agree with Manolo in his answer to a question I personally asked him – that the blogosphere’s voice is heterogeneous.

In the context of the anti-jolog sentiment, even some of the kindest people I know who were in the Fair that night drew the line between themselves and the jologs. I really do understand why people think this current blogging discourse on the UP Fair is quite “classist.” I really do. Maybe I’d be with them in this one if not for that delectable experience of being in the middle of a sea of angry jologs with barbecue sticks and water bottles who were cursing UP, the fair, the organizers, etc…

… Oh well. I’m sounding too defensive to my distaste. I’d be a bigot for now and if this becomes a prime example of classism then I think I have strengthened one of my points regarding hegemony and the discourse of the Philippine blogosphere. Quite interesting to find myself as part of the dominant bloc in this one.

good honest thoughts, these that grapple with conflicted values.  the clearly sensed perceived line between burgis and jologs is the very line that has to be crossed, and deleted, if there is to be any hope for inangbayan.  after all, burgis and jologs share many common interests, good and honest governance, transparency and the right to information, among many others.

we are them.  they are us.  ang sakit ng kalingkingan ay sakit ng buong katawan.  being burgis but concerned for the masa shouldn’t, doesn’t have to, be so hard.  some tibaks have gotten the hang of it and do a pretty good job at balancing things.

the burgis youth have as much to learn from the masa, as the masa youth from the burgis.   imagine if burgis and masa were friends that night in u.p.  that raw energy could have been channeled constructively — they could have together helped bring down those fences to accommodate everyone along some arrangement that would keep everyone happy in place.  and the next day they could together have ganged up on the concert organizers and given them hell (well, rotten tomatoes at least, and maybe some baho tsinelas) for inciting violence.  ang saya sana.
